Her husband watches porn with the excuse of stress at work

 

My husband has a high stress job and he says the only way he can relax is to engage in various sexual acts.. such as watching porn together or fantasising about threesomes.. or having sex on webcamera with someone watching.. i know all this is haram ,we have a very good relationhship otherwise.. but he pressureises me for these things and i do not want to refuse him as it creates tension in between us..i have tried talking and explaining patiently but this issue keeps coming up again and again.. i would like to add that the only thing that makes me refuse is the fear of it being prohibited in islam.. i am not forced in a nyway by him.. just a sort of pressure and if i refuse he is kind of cold towards me.. i am very worried and stressed about this.. please advise me what should i do.. and also tell me what is teh punishment for these acts.

Watching pornographic websites and sexual activity is haraam;
it is a disease, not a remedy. The one who does that is afflicted and he
should seek to remedy himself by repenting and giving it up, not by making
up excuses for himself. All sinners make up excuses for themselves. The one
who drinks alcohol or takes drugs or commits adultery – they all claim that
they are under pressure and that they cannot escape it except by doing
something haraam. 

In fact these haraam things only add to their worries and
stress. One of the punishments of sin is feelings of stress and alienation,
and darkness on the face and in the heart. The further away a person is from
his Lord and the more he is indulging in sins, the further away the means of
attaining happiness and peace of mind are from him, as Allah, may He be
exalted, says (interpretation of the meaning):

“But whosoever turns away from My Reminder (i.e. neither
believes in this Quran nor acts on its orders, etc.) verily, for him is a
life of hardship”

[Ta-Ha’ 20:124].

As for the people of faith and obedience, Allah, may He be
exalted, says concerning them (interpretation of the meaning):

“Whoever works righteousness, whether male or female,
while he (or she) is a true believer (of Islamic Monotheism) verily, to him
We will give a good life (in this world with respect, contentment and lawful
provision), and We shall pay them certainly a reward in proportion to the
best of what they used to do (i.e. Paradise in the Hereafter)”

[an-Nahl 16:97]. 

What you have to do is advise your husband to keep away from
these haraam things, and tell him about beneficial remedies to treat stress
and anxiety, one of the greatest of which is reading the Holy Qur’aan, which
is the means of bringing relief and peace to the heart. See the answer to

Secondly: 

It is permissible for the husband to enjoy his wife however
he wants, so long as he avoids intercourse at the time of menses and in the
anus. 

There are different way of enjoying intimacy that are not
forbidden in Islam, but they are off-putting to people of good taste and
sound natures; however they are permissible if the wife agrees to them. 

If your husband calls you to do something haraam, you have to
refuse and not be a party to sin and disobedience. If he calls you to do
something permissible that you find off-putting and distasteful, then it is
up to you whether you accept or refuse. If you decide to go along with it
because you are afraid he will lose interest in you, you may do so, but it
is better for you to fulfil his desires in proper ways that do not make
either of you feel put off.

What are the situations in which a promise may be broken?

 

We know that breaking promises is one of the attributes of the hypocrites, but if a Muslim is unable to keep his promise for some reason that is beyond his control, is he regarded as doing something haraam and as having one of the attributes of the hypocrites, or is he excused?.

Undoubtedly keeping promises and keeping
one’s word are attributes of the believers, and breaking promises is one of the attributes of the hypocrites, as was narrated from ‘Abd-Allaah ibn
‘Amr (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said: “There are four (characteristics),
whoever has them is a hypocrite, and whoever has one of the four has a characteristic of hypocrisy unless he gives it up: when he speaks, he lies;
when he makes a promise he breaks it; what he makes a pledge he betrays it; and when he disputes he resorts to foul language.” Narrated by
al-Bukhaari, 2327; Muslim, 58. 

The believer who makes promises to people and
breaks his promise may have an excuse or he may not. If he has an excuse then there is no sin on him, but if he does not have an excuse then he is
a sinner. 

There is no text – as far as we know – that
makes any exception regarding the prohibition of breaking promises, but it may be that promises are broken in situations where the believer is
excused. For example: 

A – Forgetting 

Allaah has forgiven us for forgetfulness
whereby obligatory actions are omitted or haraam actions are committed. Allaah says (interpretation of the meaning): 

“Our Lord! Punish us not if we forget or
fall into error”

[al-Baqarah 2:286] 

And Allaah has said: “Yes.” – Narrated by Muslim, 125, from the hadeeth of Abu Hurayrah.
According to another version, He said: “I will do that.” Narrated by Muslim, 126, from the hadeeth of Ibn ‘Abbaas. 

Whoever makes a promise to someone then
forgets the promise or forgets to do it at the time stated, there is no sin on him. 

B – Being forced to break one’s promise. 

Being forced is one of the impediments that make it permissible for a Muslim to break his
promise, such as one who is detained or is prevented from fulfilling his promise, or who is threatened with a painful punishment. 

It was narrated from Ibn ‘Abbaas that the
Prophet (peace and blessings of Allaah be upon him) said: “Allaah has forgiven my ummah for their mistakes, what they forget and what they
are forced to do.” 

Narrated by Ibn Maajah, 2045, and this
hadeeth has many corroborating reports; classed as saheeh by Shaykh al-Albaani in Saheeh al-Jaami’, 1836. 

C – A promise to do something haraam or not
to do something obligatory. 

Whoever promises someone that he will do
something haraam for him, or that he will not do something that is obligatory, it is not permissible for him to fulfil that promise. 

This may be supported by the hadeeth of
‘Aa’ishah – which is also known as the hadeeth of Bareerah – which is narrated in al-Saheehayn. ‘Aa’ishah (may Allaah be pleased with her)
had promised Bareerah’s former masters [?} that the wala’ of Bareerah [the right to inherit from her when she died – which is the right of the one
who sets a slave free – Translator] would belong to them even though ‘Aa’ishah (may Allaah be pleased with her) was the one who was going to set
Bareerah free. But she did not keep this promise because they had gone against the sharee’ah and they knew that the right of wala’ belonged to the
one who set the slave free, so how could ‘Aa’ishah set her free and then the wala’ of Bareerah belong to them? 

Al-Shaafa’i said: 

When news of that reached them, the one who
had stipulated a condition that was contrary to the ruling of Allaah and His Messenger was a sinner, and there are hudood punishments and
discipline for the sinner. One of the ways in which the sinners are disciplined is that their conditions are rendered null and void so as to deter
them and others from doing likewise. This is one of the best forms of discipline. 

Ikhtilaaf al-Hadeeth,
p. 165. 

D – If something unforeseen happens to the
one who made the promise, such as sickness, the death of a relative or breakdown of his means of transportation, etc. 

There are many excuses, which all come under
the heading of the verse (interpretation of the meaning): 

“Allaah burdens not a person beyond his
scope”

[al-Baqarah 2:286]

Ruling on the view that we should seek to acquire the characteristics of Allaah

 

One of the khateebs said in his Friday khutbah that we have to strive to acquire the attributes and characteristics of Allaah. Is there a correct way of interpreting this sentence, and is there anyone who has said this before?.

Praise be to Allaah.
 

 

This sentence is not appropriate, but there
is a correct way of interpreting it, which is that we are encouraged to strive to acquire the characteristics implied by the attributes and names
of Allaah. That means looking at the attributes which it is befitting for a created being to acquire the characteristics implied by them, unlike
the attributes which belong only to Allaah, such as His being the Creator, the Provider, the One God, etc.  These are characteristics which a
created being cannot acquire, and it is not permissible for him to lay claim to them or similar names. Rather what is referred to is the
attributes which Allaah likes for His slaves to acquire the characteristics implied thereby, such as knowledge, strength, mercy, forbearance,
generosity and forgiveness, etc. So Allaah is All-Knowing and loves those who are knowledgeable; He is Strong and He loves the strong believer
more than He loves the weak believer; He is Generous and loves those who are generous; He is Merciful and He loves those who show mercy; He is
Forgiving and loves forgiveness, etc. But when applied to Allaah, these attributes are more perfect and greater than when applied to any created
being, because there is nothing like unto Allaah in His attributes and actions, just as there is nothing like unto Allaah in His Essence. Rather
it is sufficient for a person to have a share in the sense of these attributes, in a manner that suits him and within the limits set by sharee’ah.
If his generosity oversteps the mark, then he becomes a spendthrift; if his mercy oversteps the mark, then he will not carry out the punishments
dictated by sharee’ah; if his forgiveness transgresses the limits set by sharee’ah, then it is inappropriate. This was stated by the great scholar
Ibn al-Qayyim in his books ‘Uddat al-Saabireen and al-Waabil al-Sayyib, and in other books such as al-Madaarij and Zaad
al-Ma’aad. There follows what he said in al-‘Uddah and al-Waabil: 

In al-‘Uddah (p. 310) he said:
“Because Allaah is indeed the Appreciative (al-Shukoor), the most beloved of His creation to Him are those who have the characteristic of
gratitude (al-shukr), just as the most hated of His creation to Him are those who are lacking in this characteristic or who have the
opposite characteristic. This applies to His Beautiful names: the most beloved of His creation to Him are those who have the characteristics
implied by His names, and the most hated of His creation to Him are those who have the opposite characteristics. Hence He hates those who are
ungrateful, those who do wrong, those who are ignorant, hard-hearted, miserly, cowardly and ignoble. He is Beautiful and loves beauty; He is
All-Knowing and loves those who have knowledge; He is Merciful and loves those who show mercy; He does good and loves those who do good; He is the
Concealer and loves those who conceal; He is Powerful and condemns those who act helpless, and the strong believer is more beloved to Him than the
weak believer; He is forgiving and loves forgiveness; He is One and He loves that which is odd-numbered; everything that He loves is connected to
His names and attributes; and everything that He hates is the opposite of that.” 

He said in al-Waabil (p. 543 of
Majmoo’at al-Hadeeth): “Generosity is one of the attributes of the Lord, for He gives and does not take, He feeds and is not fed, He is the
most generous of those who are generous. The most beloved of His creation to Him are those who seek to acquire the characteristics implied by His
attributes. For He is Generous and loves those among His slaves who are generous; He is All-Knowing and loves those who have knowledge; He is
All-Powerful and loves those who are courageous; He is Beautiful and loves beauty.” 

I hope that what we have mentioned will be
sufficient and will serve the intended purpose. I ask Allaah to help us all to understand His religion and to fulfil our duty towards Him, for He
is All-Hearing, Ever Near.

Our attitude towards rumours and news on the Internet

 

How should we deal with the rumours that appear on the Internet? What is the Muslim’s attitude towards the news that we read here and there, and what is written in chat rooms, especially since some of it is good news for the Muslims, but the source is unknown.


Praise be to Allaah.
 

 

We live nowadays at a time when many rumours that bring hope
are appearing in the guise of news. These appears on Internet web sites and
chat rooms, so that they may be spread to the people as glad tidings and so
that good-hearted people may accept them as indisputable facts coming from
trustworthy sources. Even if any of them could be proven, there are still
many rumours that can be classed as no more than fabrications. The one who
thinks about this will understand that many of the global media, including
the Arab media, exaggerate in their coverage of some events and they analyze
them in a subjective manner that shows a complete bias and evident absence
of objectivity, trying to take revenge by adding to the news and
exaggerating, and telling weird news stories. So there is no such thing as
credibility in these media, especially when emotions and wishes play a part.
This is apart from the fact that media objectivity has become a victim of
this current war, and western circles have rejected the lessons [of
objectivity, etc.] that they used to teach others. But this does not mean
that we should dispute the facts or deny what is taking place in reality, or
that we should face this bias with exaggeration and hopes. 

Here we should pause and remind ourselves, and the
good-hearted people who hear this news and tell it to others with good
intentions – and those who fabricate these rumours and take upon themselves
the job of propagating them – of a few facts.  

1 – We must be certain
about the news we accept, and we should not accept it simply because it
happens to coincide with our hopes and wishes. We have our own methodology
of verifying matters, and we should be consistent with regard to what we
like and dislike. It is not right for us to doubt news accompanied by
pictures from the battlefield, or to shed doubts on it, when the bottom line
is one’s senses. At a time when you see news going around through mobiles
from some internet web sites, there are some people who may accept such news
but it should be noted that there are people who will never believe it. So
they should beware of exposing themselves to being called liars. An old
proverb says, “Whoever pursues weird news will be disbelieved.” 

2 – We have to be cautious about the fact that the source is
anonymous. There is no information more important than that of the Sunnah of
the Prophet (peace and blessings of Allaah be upon him), yet despite
that it is not part of the Muslims’ methodology to accept reports of the
Sunnah from people who are unknown. Hence news must be taken from authentic
sources; if it is not authentic then it should at least be known, so that
people may be able to find out for themselves whether it is authentic or
not. What a bad habit it is for a man to say, “I heard” or “they said.” 

3 – If there are people who permit the fabrication of
rumours, basing that on some kind of ijtihaad, we must refuse to be the
means of transmitting that by believing it and propagating it. (Whoever
narrates a saying knowing it to be a lie is one of the liars). 

4 – One of the reasons used by the fabricators to justify
making up these rumours is that it is a kind of lying in war, which is
permissible. They ignore the fact – of which they are not ignorant – that
the only kind of lying that is permitted in war is that which misleads the
enemy, not that which creates illusions and deceives the Muslims. 

5 – If we have lost some aspects of the battle, we must not
lose truthfulness which is our capital in our dealings with others. People
will be astounded and amazed if they find out that this false news was
transmitted through a good man. Whoever is known to have lied or to have
transmitted lies will no longer be in a position to be considered
trustworthy.

 6 – Similarly the righteous will be astounded and will
become suspicious of a narrator who appeared to be righteous because he was
telling this news and confirming it to them. At the same time, others will
express joy, those who took the opposite stance to these youngsters and
said, “This is their news, this is their credibility!” Everyone who was
upset by the Muslim revival will find an opportunity to generalize this
mistake and accuse all the pioneers of the revival of behaving like that.
Please, for Allaah’s sake, do not make the enemy rejoice or give them a
reason to attack. 

7 – If truthfulness is an Islamic virtue and part of Arabic
chivalry, then telling lies is an obscenity that Islam has forbidden. Even
the mushrik Arabs refrained from telling lies, as Abu Sufyaan – when he was
still a mushrik – said: “Were it not that I am afraid that people may find
out that I had told a lie, I would have told lies about him.” That was when
he was speaking to Heraclius (about the Prophet (peace and blessings of
Allaah be upon him)). He did not want to have even one lie to be found in
his history, even if it was a lie told against his enemy Muhammad
(peace and blessings of Allaah be upon him) to Heraclius (the Roman ruler).
We are concerned that the propagation of these rumours may lead people to
record a lot of lies against us. 

8 – Fabricating rumours and believing them readily is a form
of escapism in the face of a reality which one dislikes and with which one
does not feel comfortable.  

The soul finds consolation in denying that which it does not
like and in fabricating and disseminating rumours, but in the end it will
have to submit to the authority of overwhelming reality. But this
psychological trick is not fit to be the means of escapism for the followers
of Muhammad (peace and blessings of Allaah be upon him), who taught
them the virtues of truthfulness and commanded them to strive their utmost
to be truthful. He said: “Truthfulness leads to righteousness and
righteousness leads to Paradise. A man will continue to speak the truth and
strive to be truthful, until he will be recorded with Allaah as a speaker of
the truth. And lying leads to immorality and immorality leads to Hell, a man
will continue to tell lies and strive in telling lies, until he will be
recorded with Allaah as a liar.” 

9 – Delaying recognition of realities and veiling reality
with illusions, the greatest form of which is believing and disseminating
rumours, will only multiply the amount of losses, and the greatest loss will
be the loss of values. The highest and most precious of those values is
truthfulness. “then if they had been true to Allaah, it would have been
better for them” [Muhammad 47:21 – interpretation of the meaning]

 10 – Recognizing the truth is the first step towards dealing
with crises and overcoming them, but not admitting them and concealing them
are among the greatest means of reinforcing them, renewing them and
repeating them.

 11 – Our advice is not to transmit this news. We must advise
those who transmit it with the best of intentions and present them with the
real facts, we should not try to spare their feelings at the expense of our
reason and the transmission of truthful news, and we should try to rescue
them from the anxiety of illusion and point them in the direction of
reality, because truthfulness brings peace of mind and lies bring suspicion.

 12 – Sayyid Qutub (may Allaah have mercy on him) said: “The
reality of a thing defeats the outward appearance of another thing, even if
it is the reality of kufr.” 

How I wish that I did not have to talk in this manner, but
the problem is there and must be addressed. I have tried to be truthful when
speaking about truthfulness, for the dearest of speech to Allaah is that
which is most sincere. 

“O you who believe! Be afraid of Allaah, and be with those
who are true (in words and deeds)”

[al-Tawbah 9:119 – interpretation of the meaning] 

O Allaah, show us the truth as truth and enable us to follow
it; show us the false as false and enable us to avoid it. Guide us
concerning disputed matters of truth by Your leave, for You guide Whomsoever
You wish to the Straight Path. 

May Allaah send blessings and peace upon our Prophet Muhammd
and upon his family and companions. 

Now days we as Muslims have to spread the voice to learn quran and so we could gain the true knowledge and the quran teaching that is give to us by our beloved prophet Muhammad peace be upon him and do quran reading. Do we as Muslim ask our self that why we are at the peak of destruction? The answer will be simple that we have left our roots the holy quran we should guide promote Islam from in our homes first and let learn our kids quran  and encourage them in doing quran memorization this should be our first goal for it we can do different stuff like let then participate in different online quran recitation competition to let them listen quran from different online quran reciters and along with it we elders should learn quran also and improve our knowledge of quran and Islam and learn holy quran tafseer because to understand and learn quran Arabic and for this now a days there are many online quran tutor available who teach tajweed quran and its translation and tafseer so let us join our hands to be the voice of Islam and let improve the image of it as well and full fill our duty .

Stuffing the skin of an animal so that it becomes like a statue (taxidermy)

 

I know that making statues is haraam, but if a person has a tiger skin or a skin of an onager or ram, and he stuffs it with straw or cotton, and makes a head and limbs for it the same colour as the skin, and puts it in the entryway to his house or sitting room for the purpose of decoration only, is this regarded as haraam or permissible?.

Praise be to Allaah.

It is haraam to do what is mentioned, because it is similar
to statues, and because it is idle activity in which there is no benefit. 

And Allah is the source of strength. Make Allah send
blessings and peace upon our Prophet Muhammad and his family and Companions.

Her passport picture is without hijab – can she travel with it?

 

It is known that it is a must to put a personal photo on the passport. My problem is that my picture on the passport is without hejaab; as I was young when I got the passport done. My father has renewed my passport but did not change the picture, and when I asked for the picture to be changed, I was told that it can not be changed so long as it is valid. It will become invalid in one year, I fear travelling like this but my father loves to travel and he will force me to travel with him. Enlighten me please my Allah guide you!.

The fact that you do not
want men to see your picture without hijab indicates that Allaah has blessed
you with faith and modesty. This is how a Muslim girl should be, keen to
observe hijab, cover herself and be chaste. May Allaah increase you in
steadfastness and faith. 

Your father should
understand that you are keen to cover yourself, and he should appreciate
that, and not force you to travel now, because you do not have the right to
enable men to see your picture unnecessarily. But if he insists and forces
you to travel and you cannot  stay behind, then you may destroy the passport
so that you can apply for another. If that is not possible, then there is no
sin on you for travelling with your father. 

But if the picture of you
was taken before you reached puberty, then the matter is easy, because hijab
was not obligatory for you at that time.

Ruling on drawing smiley faces when chatting on the internet

 

Drawing faces or pictures of living beings is haram, but on forums and other places on the internet people draw emoticons using symbols, for example :D represents a smiling face if u look at it vertically. is this haram?.

Praise be to Allaah.

It seems – and Allaah knows
best – that this face, whether it is smiling or sad, does not come under the
same ruling as images that it is forbidden to make, draw, or use, for two
reasons: 

1 – It contains none of the
features of a real face, such as eyes, mouth and nose, and it has no head or
ears. 

The Prophet (peace and
blessings of Allaah be upon him) said: “The image is the head; if the head
is cut off, there is no image.” Narrated by al-Ismaa’eeli in his Mu’jam
from the hadeeth of Ibn ‘Abbaas and classed as saheeh by al-Albaani in
al-Silsilah al-Saheehah no. 1921 and in Saheeh al-Jaami’ no.
3864. 

2 – The majority of fuqaha’
are of the view that if something is cut off from an image without which it
could no longer live, then it is not a haraam image. For a detailed
discussion of this issue and the views of other madhhabs, see Ahkaam
al-Tasweer fi’l-Fiqh al-Islami, pp. 224-240. 

But we should point out two
things: 

This usage in chatting on
the internet does not come under the drawing of images, rather it comes
under the use of images.

Secondly: A woman should
not use these images when speaking to a man who is not her mahram, because
these faces are used to express how she is feeling, so it is as if she is
smiling, laughing, acting shy and so on, and a woman should not do that with
a non-mahram man. 

It is only permissible for
a woman to speak to men in cases of necessity, so long as that is in a
public chat room and not in private correspondence. See question no.
34841.

She advised him and he came to thank her, and they committed zina

 

I am a young woman from a very well-known family. All my life I have been religiously committed and of good character, as all will attest, but I do not know what is the reason that caused me to get to know a young man. I wanted to help him because he had suffered the calamity of his father’s death, and he is responsible for his siblings and his mother, but he went down the path of keeping company with bad people. I advised him and I felt it was my duty to stand beside him and advise him sincerely. Eventually he returned to his studies and gave up those bad friends, and he changed completely. His mother asked him the reason, and he told her. She spoke to me and thanked me for being patient with her son. One day he came for a visit to see me, and I did not know why I did not hesitate. I went to see him, and I felt as if he was my brother. We spent some time together and what happened happened, unfortunately. Now he wants to come and propose marriage to me, but it is impossible. He is three years younger than me, and he is not of the same nationality as me. Now I am pregnant and I want Allaah to conceal my sin and I want to repent. I know that I have done wrong, and you will criticize me severely, but I want to repent and I want a solution.

Praise be to Allaah.

Firstly: 

Perhaps your letter will be a lesson to those who claim that
a relationship between a man and a non-mahram woman can be “innocent”, and
to those who claim that such relationships are Islamically acceptable if
they are for the purpose of giving advice, and to those who want to “water
down” the religion to allow relationships between men and women in the name
of modernity, and claim that there is no reason why this should not be done,
and that woman are able to control themselves… and other such foolish
justifications. 

It is a lesson for all those who are heedless of the laws of
Allaah and pay no attention to the warning of our Lord, may He blessed and
exalted, against following in the footsteps of the shaytaan, and they
continue to take these matters lightly until they find themselves in deep
trouble. You were heedless with regard to this young man and you went ahead
and spoke with him and advised him, then you agreed to receive him in your
house, then you agreed to be alone with him, then the Shaytaan made
attractive to you the idea that he was like your brother, then what? Then
you committed zina in the same meeting and in your house, with one whom the
shaytaan made you think was like your brother! Which was the first step of
the shaytaan? It was speaking to this non-mahram man, then the other steps
of the shaytaan came one after another until you committed this most
abhorrent of sins. Hence we can see the wisdom in the words of Allaah, may
He be exalted (interpretation of the meaning): 

“And come not near to unlawful sex. Verily, it is a
Faahishah (i.e. anything that transgresses its limits: a great sin), and an
evil way (that leads one to hell unless Allaah Forgives him)”

[al-Isra’ 17:32] 

Allaah did not only
forbid zina itself, rather He forbade coming near to it. The aim here is to
forbid the things that lead to it. We ask Allaah to conceal your sin and to
forgive you, and to help you to repent sincerely. 

Secondly: 

There is no doubt that zina is a grave sin, and it is one of
the major sins. Hence the punishment for it is one that points to the
seriousness of this sin and the abhorrence with which it is regarded in
sharee’ah and by wisdom and common sense. 

Ibn al-Qayyim (may Allaah have mercy on him) said: 

Allaah ordained punishment for zina that differs from the
punishment for other crimes in three ways: 

1 – Execution in the most unpleasant form; when the
punishment is reduced, it still combines the physical punishment of flogging
with the emotional punishment of banishment. 

2 – He forbade people when carrying out the punishment on the
adulterers, to feel pity for them that would prevent them from carrying out
the punishment. By His mercy towards them He prescribed this punishment, and
He is more merciful to them than you, but His mercy did not prevent Him from
ordaining this punishment, so your pity should not prevent you from carrying
out His command… 

3 – He enjoined that
their punishment be carried out in the presence of some of the believers; it
should not be done in isolation where no one can see them. That is more
effective in serving the purpose of the punishment, and serves as a
deterrent. End quote. 

Al-Jawaab al-Kaafi, p. 144, 115 

Thirdly: 

Although this sin is so serious and abhorrent, Allaah has
opened the door of repentance to those who commit it, and He has promised
that if they are sincere in their repentance, He will turn their bad deeds
into good deeds.  

Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allaah have mercy on him)
was asked: 

What should the person who has committed zina do in order to
rid himself of the effects of that action of his? 

He replied: 

Zina is one of the most serious of haraam actions and the
worst of major sins. Allaah warns the mushrikeen, murderers and adulterers
of multiple punishments on the Day of Resurrection, and of eternal
humiliation and torment, because of the seriousness and abhorrence of their
crimes, as Allaah says (interpretation of the meaning): 

“And those who invoke not any other ilaah (god) along with
Allaah, nor kill such person as Allaah has forbidden, except for just cause,
nor commit illegal sexual intercourse —
and whoever does this shall receive the punishment.

69. The torment will be doubled to him on the Day of
Resurrection, and he will abide therein in disgrace;

70. Except those who repent and believe (in Islamic
Monotheism), and do righteous deeds”

[al-Furqaan 25:68-70] 

The one who has fallen
into such sin has to repent to Allaah sincerely, and follow that with
sincere belief and righteous deeds. Repentance is sincere if the penitent
gives up the sin, regrets what has happened in the past and resolves never
to go back to it, out of fear of Allaah and awe of Him, hoping for His
reward and fearing His punishment. Allaah says (interpretation of the
meaning): 

“And verily, I am indeed forgiving to him who repents,
believes (in My Oneness, and associates none in worship with Me) and does
righteous good deeds, and then remains constant in doing them (till his
death)”

[Ta-Ha 20:82] 

Every Muslim man and
Muslim woman must beware of this great evil and the things that lead to it,
and hasten to repent from whatever is already past. Allaah will accept the
repentance of those who are sincere and forgive them.

9/442 

Fourthly: 

It is not permissible for two people who have committed zina
to get married except after having repented sincerely, because Allaah has
forbidden that to the believers: 

“The adulterer —
fornicator marries not but an adulteress — fornicatress or a Mushrikah; and
the adulteress –fornicatress, none marries her except an adulterer —
fornicater or a Mushrik [and that means that the man who agrees to marry
(have a sexual relation with) a Mushrikah (female polytheist, pagan or
idolatress) or a prostitute, then surely, he is either an adulterer —
fornicator, or a Mushrik (polytheist, pagan or idolater). And the woman who
agrees to marry (have a sexual relation with) a Mushrik (polytheist, pagan
or idolater) or an adulterer — fornicator, then she is either a prostitute
or a Mushrikah (female polytheist, pagan, or idolatress)]. Such a thing is
forbidden to the believers (of Islamic Monotheism)”

Fifthly: 

If the soul has been breathed into the foetus, then aborting
it would be another crime in addition to zina. We have explained the ruling
on this issue in the answer to questions no.

Sixthly: 

The solution to your problem is to inform wise people among
your family about your situation. The one who transgresses the laws of
Allaah must inevitably face the consequences of his sin, in many cases. The
family has to stand with their daughter sooner rather than later. Even if
she aborts the foetus before the soul has been breathed into it, she is no
longer regarded as a virgin, and this will also cause some problems at the
time of marriage. Whatever the case, they have to solve their daughter’s
problem, for she has repented and regretted her sin, and “the one who
repents from sin is like one who has not sinned at all” – narrated by Ibn
Maajah, 4250; classed as hasan by al-Albaani in Saheeh al-Targheeb,
3145. Even if she does not commit any sin after she repents, her sin has
serious repercussions which must be dealt with before news of it becomes
widespread and affects the family as a whole. The solution is not to marry
her to that zaani before he repents, because marriage to a zaani is haraam,
as stated above. But if they both repent, there is nothing wrong with them
getting married in sha Allaah. 

It is not permissible for her to marry anyone else until her
womb is emptied, which is when she gives birth. The evidence for that is the
report narrated by Abu Sa’eed al-Khudri (may Allaah be pleased with him)
from the Prophet (peace and blessings of Allaah be upon him), who said:
“Do not have intercourse with a pregnant woman until she gives birth, or
with one who is not pregnant until she has menstruated once.” Narrated by
Abu Dawood, 2157. al-Haafiz Ibn Hajar said in al-Talkhees al-Habeer
(1/171,172): Its isnaad is hasan.

He had anal intercourse with a foreign woman but they have repented. Is it permissible for them to get married?

 

We had anal intercourse, but we repented and regretted. We love each other very much we cannot separate. We want to marry and live a happy life. Is it permissible for us to get married?


We follow the ibadhi madhab, and it prohibits marriage between a man  and a woman who committed adultry even if they repent. The evidence for this is that Umar ibn al-khattab separated a man who married a woman during her ‘iddah and said: “they shall never be togeather”, another evidence narrated by Ali, A’esha, and albaraa ben azeb, that “if a man and awoman who committed adultry got married, their relationship remains adultry forever”. Trust cannot be there between two who tested each other before marriage. What is your opinion?.

Firstly: 

You should understand that looking for the right opinion on
practical fiqhi matters is something good, and it indicates that a person is
seeking the truth that Allaah has enjoined. Even better than this is that a
Muslim should look for the correct belief that will save him from the
misguided sects which the Prophet (peace and blessings of Allaah be
upon him) spoke of. He said that there would be seventy-two sects, “all of
which will be in the Fire” meaning that they are misguided and deserve this
warning of Hell. 

If you both regret what you did and have repented sincerely,
then it is permissible for you to get married, and there is no reason why
you should not do so. 

As for what you say about ‘Umar ibn al-Khattaab preventing
the one who married a woman during her ‘iddah from ever marrying her, it
seems – if this is a sound report – that this was a punishment (ta’zeer) to
the one who committed a sin, and it was not a confirmation of a shar’i
ruling that this is haraam. 

What you have quoted from some of the Sahaabah, that they
ruled that a couple who committed zina and then get married would remain
adulterers forever, may be understood as applying to those who did not
repent. 

Ibn Hazm (may Allaah have mercy on him) said: 

It was narrated from Ibn Mas’ood that he said concerning the
one who marries a woman after committing zina with her: They are still
adulterers. Then he narrated that Saalim ibn ‘Abd-Allaah ibn ‘Umar was asked
about a man who committed zina with a woman then married her. He said: Ibn
Mas’ood was asked about that and he said: “And He it is Who accepts
repentance from His slaves” [al-Shoora 42:25]. 

Ibn Hazm said:  

The two opinions (of Ibn Mas’ood) are in harmony, because he
only allowed marrying that woman after repentance. End quote.

He committed zinaa then he became Muslim; should he be subjected to the punishment?

 

If
a kaafir commits zinaa (unlawful sexual intercourse) then he becomes
Muslim, should the hadd punishment be carried out on him?

Praise be to Allaah. 

If a dhimmi (Jew or
Christian living under the protection of the Islamic state) commits zinaa
then becomes Muslim, and there is evidence to prove that he did commit
zinaa, the hadd punishment is no longer to be applied to him; he should
not be punished by either hadd (punishment specified in sharee’ah) or
ta’zeer (punishment to be specified by the qaadi or Muslim judge in a
particular case). This was the view of al-Shaafa'i, based on the aayah
(interpretation of the meaning):

“Say
to those who have disbelieved, if they cease (from disbelief), their past
will be forgiven” (al-Anfaal 8:38).

He also quoted as evidence
the hadeeth of the Prophet
(peace and blessings of Allaah be upon
him):

“Islam wipes out whatever
came before it.” (Narrated by Muslim from ‘Amr ibn al-‘Aas).

The Qur’aan also states
that the punishment for a thief or bandit is no longer applicable if they
repent, so this reprieve is more applicable in the case of a kaafir (who
becomes Muslim). Moreover, enforcing the punishment would put people off
Islam. This is the same reason which is given by scholars for stating that
a person who enters Islam does not have to make up the prayers that he has

She committed adultery when she was a minor – should the hadd punishment be carried out on her?

 

What is the punishment for a girl found guilty of adultery if she has not even reached her puberty that is she is still a minor ?.

The sin of adultery (zina: unlawful sexual relationship) is a
major sin which Allaah has mentioned in conjunction with kufr, shirk and
murder, as He says (interpretation of the meaning): 

“And those who invoke not any other ilaah (god) along with
Allaah, nor kill such person as Allaah has forbidden, except for just cause,
nor commit illegal sexual intercourse
and whoever does this shall receive the punishment.

The torment will be doubled to him on the Day of
Resurrection, and he will abide therein in disgrace”

[al-Furqaan 25:69] 

Al-Qurtubi said: 

The followers of all
religions are agreed that adultery is forbidden; no religion regards it as
permissible. Hence the punishment for it is one of the most severe
punishments, because it is a crime against honour and lineage, which is one
of the five basic principles that Islam seeks to protect, namely life,
religion, lineage, reason and wealth.  

Tafseer al-Qurtubi, 24/20, 21 

1 – If a woman has been
previously married – i.e., a legitimate marriage with her has been
consummated – then her punishment is to be stoned to death. 

‘Umar ibn al-Khattaab (may Allaah be pleased with him) said,
when he was sitting on the minbar of the Messenger of Allaah (peace and
blessings of Allaah be upon him): “Allaah sent Muhammad (peace and
blessings of Allaah be upon him) with the truth, and revealed to him the
Book. One of the things that He revealed was the verse of stoning, which we
have read and understood. The Messenger of Allaah (peace and blessings
of Allaah be upon him) carried out the punishment of stoning and we did so
after him. I fear that as time goes by, people will say, ‘We do not find any
mention of stoning in the Book of Allaah,’ so they will go astray by
forsaking an obligation that was revealed by Allaah. In the Book of Allaah,
stoning is the punishment deserved by any previously-married person, man or
woman, who commits adultery, if proof is established, or pregnancy results,
or he or she confesses.” 

(Narrated by al-Bukhaari, 2462; Muslim, 1691) 

2 – If the woman is a virgin – i.e., she is not married yet
or the marriage contract has been done but her husband has not yet
consummated the marriage with her – then the punishment is one hundred
lashes and exile from her country for a year, as stated in the hadeeth of
‘Ubaadah ibn al-Saamit, who narrated that the Prophet (peace and
blessings of Allaah be upon him) said: “Receive (teaching) from me. Allah
has ordained a way for those (women). When an unmarried male commits
adultery with an unmarried female (they should receive) one hundred lashes
and banishment for one year. And in the case of a married male committing
adultery with a married female, they shall receive one hundred lashes and be
stoned to death.” 

(Narrated by Muslim, 1690). 

If the adulterer or adulteress is a minor below the age of
puberty, then there is no punishment to be carried out, according to all
scholars. 

Ibn Qudaamah (may Allaah have mercy on him) said: 

With regard to puberty and sound mind, the scholars are
agreed that both are conditions of punishment being obligatory.  

Al-Mughni, 8/134. 

The evidence for that is
the words of the Messenger of Allaah (peace and blessings of Allaah be
upon him): “The Pen has been lifted from three, from the sleeper until he
awakes, from the minor until he grows up, and from the insane until he
regains his reason.” (Narrated by al-Nasaa’i, 3432; classed as saheeh by
al-Albaani in Saheeh al-Nasaa’i, 3210). 

But the minor boy or girl
should be punished, with something less than the hadd punishment, in a
manner that will deter them from doing this action. And their guardian must
also be punished if there was any shortcoming on his part, such as allowing
his daughter to mix with boys or being careless concerning such matters. 

The girl has to conceal what she has done, and her guardian
must also conceal it, because the Prophet (peace and blessings of
Allaah be upon him) said: “Avoid these filthy things that Allaah has
forbidden. Whoever has done any of them, let him conceal himself with the
concealment of Allaah, and let him repent to Allaah…” 

(Narrated by al-Haakim; classed as saheeh by al-Albaani in
Saheeh al-Jaami’, 149). 

If the signs of puberty
are present in the boy or the girl, then he or she becomes accountable
(mukallif) thereby. Information on these signs may be found in Questions

Why should a person who disbelieves after becoming Muslim be executed?

 

The punishment for the apostate is execution. Why such harshness?.

Praise be to Allaah.
 

 

The punishment for apostasy from the religion of Islam is
execution. Allaah says (interpretation of the meaning): 

“And whosoever of you turns back from his religion and
dies as a disbeliever, then his deeds will be lost in this life and in the
Hereafter, and they will be the dwellers of the Fire. They will abide
therein forever”

[al-Baqarah 2:217] 

And it was proven that
the Prophet (peace and blessings of Allaah be upon him) said: “Whoever
changes his religion, execute him.” Narrated by al-Bukhaari in his Saheeh.
What this hadeeth means is that whoever leaves Islam and changes to another
religion and persists in that and does not repent, is to be executed. It was
also proven that the Prophet (peace and blessings of Allaah be upon
him) said: “It is not permissible to shed the blood of a person who bears
witness that there is no god but Allaah and that I am the Messenger of
Allaah except in three cases: a life for a life, a previously-married person
who commits adultery, and one who leaves Islam and forsakes the jamaa’ah.”
Narrated by al-Bukhaari and Muslim. 

This harsh punishment is for a number of reasons: 

1 – This punishment is a deterrent to anyone who wants to
enter Islam just to follow the crowd or for hypocritical purposes. This will
motivate him to examine the matter thoroughly and not to proceed unless he
understands the consequences of that in this world and in the Hereafter. The
one who announces his Islam has agreed to adhere to all the rulings of Islam
of his own free will and consent, one of which rulings is that he is to be
executed if he apostatizes from the faith. 

2 – The one who announces his Islam has joined the jamaa’ah
(main body) of the Muslims, and whoever joins the main body of the Muslims
is required to be completely loyal and to support it and protect it against
anything that may lead to fitnah or destroy it or cause division. Apostasy
from Islam means forsaking the jamaa’ah and its divine order, and has a
harmful effect on it. Execution is the greatest deterrent that will prevent
people from committing such a crime.

3 – Those Muslims who are weak in faith and others who are
against Islam may think that the apostate has only left Islam because of
what he has found out about its real nature, because if it were the truth
then he would never have turned away from it. So they learn from him all the
doubts, lies and fabrications which are aimed at extinguishing the light of
Islam and putting people off from it. In this case executing the apostate is
obligatory, in order to protect the true religion from the defamation of the
liars and to protect the faith of its adherents and remove obstacles from
the path of those who are entering the faith. 

4 – We also say that the
death penalty exists in the modern laws of man to protect the system from
disorder in some situation and to protect society against certain crimes
which may cause its disintegration, such as drugs etc. If execution can
serve as a deterrent to protect man-made systems, then it is more
appropriate that the true religion of Allaah, which Falsehood cannot come to
it from before it or behind it  [cf. Fussilat 41:42], and which is all
goodness, happiness and tranquility in this world and in the Hereafter
should punish those who commit acts of aggression against it and seek to
extinguish its light and defame its image, and who fabricate lies against it
to justify their apostasy and deviation.
